1. PRIVACY POLICY STATEMENT REGARDING WEBSITE
Your personal information will not be shared with anyone or used for communication or marketing purposes unless you indicate you allow this. We store personal information in a secure database with restricted access. You may indicate that you do not wish to receive communications from us by contacting us at info@theginbox.co.za.
Our website is owned by Gin Box (Pty) Ltd trading as The Gin Box.
2. WEBSITE CONTENT
We, at The Gin Box, have endeavoured to ensure that all information on this website is as accurate as possible. The information is provided is in good faith. The use of any product bought by you from this site is at your risk. You indemnify us and hold us harmless against any loss, injury or damage which may be sustained as a result of using any one of the products sold on the website.
3. EXCLUSIVE RIGHTS OF COPYRIGHT
You may not use the trademarks, logos or names of The Gin Box in any advertising or publicity, or otherwise to indicate The Gin Box’s sponsorship of or affiliation with any product or service, without prior written permission. Anything posted on this site is subjected to copyrights owned by The Gin Box.
This website contains images, copy text, videos, content which for these purposes are defined as proprietary works and the compilation of the proprietary works are the copyright of The Gin Box, its affiliates or subsidiary, or any other third party owner of such rights; and is protected by South African and international copyright laws. The Gin Box reserves the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any time and without notice. All rights in and to the Content are reserved and retained by The Gin Box. Except as specified in these Terms and Conditions, you are is not granted a licence or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.
4. DESCRIPTION OF GOODS AND/OR SERVICES
The Gin Box is an online and direct marketer of small batch artisanal gins that are not widely available – Each month you will receive a full-sized bottle of gin, a few tonic waters, and number of other hand chosen paired products.
5. SECURITY OF CREDIT CARD DETAILS
Credit card transactions will be acquired for The Gin Box via PayGate (Pty) Ltd. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view Pay Gate’s security certificate and security policy.
6. CUSTOMER DETAILS
Your details will be stored by The Gin Box separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
7. MERCHANT TRANSACTION CURRENCY
The Gin Box can only accept South African orders. Transaction Currency is South African Rand (ZAR).
8. THE GIN BOX’S PROMISE
The Gin Box takes full responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods
9. PRIVACY POLICY
The Gin Box takes all reasonable steps to protect user’s personal information as defined in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

10. PAYMENT OPTIONS
Visa, MasterCard credit card payments will be accepted.
11. GIFT VOUCHERS
The Gin Box may from time to time make physical or electronic gift vouchers available for use on the Website towards the purchase of The Gin Box Goods. Gift Vouchers can only be redeemed while they are valid and their expiry dates cannot be extended. More specifically:
- Gift Vouchers that are purchased by registered users are valid for 3 years after Sale. Gift Vouchers that The Gin Box gives away for free are valid for the period stated thereon. In each case, if your Voucher has not been used within that period, it will expire.
- Gift Vouchers cannot be used to buy other Gift Vouchers or Coupons. They do not accrue interest and are not refundable for cash once purchased. If your Gift Voucher value is insufficient for the order you wish to place, you may make up the difference by paying via one of our other payment methods.
- The Gin Box Gift Vouchers can only be redeemed online through our website (www.theginbox.co.za)
- The Gin Box is not responsible for any harm due to the loss, unauthorised use or unauthorised distribution of a Gift Voucher, after it has delivered the Gift Voucher to you or the email address nominated by you.
12. DISCLAIMER
The Gin Box is not responsible if you cannot access the Site properly or at all because your connection, the Internet generally or your browser software is inadequate or functioning badly, or if your ISP suspends or terminates their service to you, or because of any other event outside our control. If you cannot access the Site properly or at all because any of these reasons, The Gin Box will not refund any money you have paid or compensate you. Please be sure to report any possibly errors to The Gin Box.
The Site relies in part on software to work. Software has bugs. Whilst The Gin Box will monitor the Site and try to fix bugs that are made known to us, we cannot guarantee that the Site will be bug-free or will work all the time. It is not a term of these T’s and C’s that the Site or any individual feature of the Site will always be available, error free and/or free from viruses.

Where the Site contains links to other websites and third party products or services, these links are provided for your information only. The Gin Box is not responsible for the content of these websites or products or services. No person, business or website may link to any page on this site without the prior permission of The Gin Box. In the event that The Gin Box does provide a hyper link to other websites or articles, this does not mean that The Gin Box endorses those sites or the content in any way.
14. SECURITY
By accessing or using any part of the site, you accept, without limitation or qualification, these T’s and C’s. If you do not agree with all of the T’s and C’s, you may not use any portion of the site. Price information found on this site is subject to change without notice. The Gin Box reserves the right to change these T’s and C’s at any time without notice, but will not change these T’s and C’s in relation to orders which have been placed and acknowledged by The Gin Box before the change is made. We grant you a personal, limited, non-transferable non-exclusive, licence to access and use the Site. We reserve the right, in our sole discretion and without notice to you, to revise the products and services available on the Site and to change, suspend or discontinue any aspect of the Site and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on the use of the Site or restrict your access to part, or all, of the Site without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes. Any person who delivers damaging code to this site may be prosecuted and damages may be claimed.
15. GOVERNING LAW
This site is controlled, operated and administered by The Gin Box from the Republic of South Africa and therefore the South African law applies. These T’s and C’s shall be governed by the laws of RSA and your consent to the jurisdiction of Cape Town High Court in the event of any dispute.
16. DELIVERY DETAILS
We deliver door-to-door countrywide. The delivery cost is included in your R729 subscription pack, regardless of your frequency.
Additional purchases can be done at a delivery cost of R99 per package, anywhere in South Africa. We work on a 5-7 working day delivery turnaround time.

17: INSURANCE
Your Gin Box is insured against breakage and theft, an insurance equal to 1.8% of the value of your purchase is included in the cost of the product.
18: CORPORATE GIN BOX ORDERS
Branding and delivery costs are not included in the advertised price of these boxes.
19: REFUND
We cannot refund you for your Gin Box once you have received it. If you would like to cancel your subscription, you are welcome to do so before the 23rd of the month before your next subscription. We can definitely replace bottle damaged upon arrival.
20: REPLACING GOODS
In the unlikely event that there is a broken bottle in your Gin Box, please tell us immediately by emailing info@theginbox.co.za indicating your concern. Please attach pictures of the damaged bottle/bottles as you received it (preferably a photo showing exactly how you received the box) to the email. We will respond to you as soon as we can and will send you a new bottle as quickly as possible. We reserve the right to substitute product if product runs out, to the same or higher value of the damaged item.
21. AGREEMENT CHANGES
The Gin Box may, in its sole discretion, change this agreement or any part thereof at any time without notice.
22. INSTAGRAM COMPETITION RULES
These terms will apply to all competitions offered by The Gin Box. In the event of conflict between these terms and the rules applicable to any specific competition, the specific competition’s rules will prevail. Only South African residents are eligible for prizes, and delivery of gifts or prizes will only be within South Africa. Entry is open to anyone except employees (and their immediate families) of The Gin Box or the sponsoring company/companies. No cash alternative is available to any prize unless expressly stated otherwise. The closing date for any competition will be as stated. The judges cannot accept responsibility for late entries. Entrants must also be over 18 years of age. Entrants expressly declare that they are duly authorized to participate in the competition. Entrants to regular competitions may only win once within a year. The judges’ decision is final and no correspondence will be entered into. All entrants’ information will be used only in accordance with our Privacy Policy. We reserve the right to cancel any competition without notice at any time. We may re-allot prizes if we are unable to contact selected winners. Please ensure that you provide the correct contact details. Prizes not claimed within 3 months will be forfeited. Any deviation from the rules and/or attempt to manipulate the outcome of the prize will result in disqualification. Winners may be required to be photographed for publicity purposes or to participate in a radio or television broadcast. No fees will be payable in this regard. Prizes are non-transferable in whole or in part, must be taken as stated and may not be sold to a third party. You must confirm acceptance of the prize as stated, failing which you will no longer be eligible for a prize, and that prize will be re-allotted. Where prizes involve travelling abroad, winners must be in possession of a valid passport, required visas and the relevant health certificates. We accept no responsibility for any incorrect or incomplete registration details that you may supply as part of your registration. No responsibility will be accepted for undelivered, lost or delayed entries. Proof of sending is not proof of receipt. Errors in entries may, in the judge’s discretion, void entries. By entering into a competition it is deemed that you have read and understood these rules. In the case of a competition by means of a draw, the draw will take place within 3 weeks of the closing date of the competition, unless otherwise stipulated.
23. ALCOHOL SALES
By ordering and purchasing products that contain alcohol, you acknowledge that you are of legal drinking age. Alcohol is not for sale to persons under the age of 18. For this reason, positive identification may be requested and we may refuse an order at our discretion.
24. RETURNS POLICY
If you have used a product and found it to be damaged or faulty, please send us a photograph and we will collect the product at our expense and either replace or repair the item, depending on the circumstances and date of purchase.
25. RETURNS POLICY – CONSUMABLES
Should you order a perishable item and you have had a change of mind, you will not be able to return the item. While we do our utmost to provide as much information on a product and only list quality products, we are not able to refund or exchange items due to public and food safety regulations. If, however, your perishables have arrived damaged or expired we will replace or refund when we or the supplier are at fault, according to our Refund Policy.
26. UPDATING OF THESE TERMS AND CONDITIONS
We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
27. Friend Referral T&C’s:
The referrer and the referee must have different shipping addresses. Members may not refer themselves by setting up multiple accounts. This code (GINBUDS100) cannot be used on annual gift memberships or in conjunction with any other discount, unless otherwise stated.
The refers successfully awarded R50.00 Coupon can only be used once. Can only be used on a NEW order. Can be used once per order. Coupon expires with in 90 days of creation.
28. CANCELLATION
You may cancel your Gin Box membership at any time. As of 1 January 2021, should a pack show as dispatched on our system i.e. already on route, it will be seen as the last box sent to the member. The Gin Box will cancel all boxes thereafter.
